COMPLETE COMMUNICATION COMMITMENT GULF COAST TELECO is authorized to place under Complete Communication Commitment the equipment listed for a period of one year at the prevailing rates. The Complete Communication Commitment includes the following services: EQUIPMENT INSURANCE: GULF COAST TELECO agrees to provide the Customer during GULF COAST TELECO’s normal business hours, the maintenance service necessary to keep the equipment in, or restore the equipment to, good working order in accordance with GULF COAST TELECO’s policies then in effect. Interim service calls are included in this agreement other than those caused by fire, floods, riots, or acts of God. Limited lightning & surge protection is included. Maintenance will include adjustments, and replacement of maintenance parts deemed necessary by GULF COAST TELECO. Maintenance parts will be furnished on an exchange basis and the replaced parts become the property of GULF COAST TELECO. Maintenance service provided under this agreement does not assure uninterrupted operation of the equipment. Response times for service calls placed with GULF COAST TELECO will be 4 hours for a Major outage & 8 hours for normal outage. Major outage is classified as a loss of 1/3rd internal or external service. Normal outage is classified as any request for service other than listed above. Hours are measured in GULF COAST TELECO’s normal business hours. PROGRAM CHANGES: Program changes, Professional key strips, and on going training are provided for all users under this agreement. AFTER HOURS MAINTENANCE: Maintenance performed outside GULF COAST TELECO’s normal business hours will be covered under the terms of this agreement. ADDITIONAL DISCOUNTS: This agreement qualifies for a 10% discount on cabling additions or re-locations. QUALIFICATIONS: Customer understands that liability arising out of, or connected with services performed under this agreement, is limited. GULF COAST TELECO will not be responsible for economic loss, including loss of profit or equipment use or for any claim against Customer by a third party. Transfer of equipment covered by this agreement to a location outside normal servicing area will exclude it from the terms of this agreement. The charge on equipment transferred to a different location during the term of this agreement will be adjusted to the applicable rate for the new location. GULF COAST TELECO may suspend performance under this agreement if Customer is in default or in arrears in payment under this agreement. |
